1. Agreement
These Terms of Service ("Terms") govern access to and use of Graphe Cloud, the Graphe marketing website, APIs, SDKs, CLI, MCP server, and related services (collectively, the "Service") operated by Graphe ("Graphe," "we," "us," or "our").
By creating an account, using the Service, or accessing our APIs, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
If you do not agree, do not use the Service.
2. The Service
Graphe is a developer platform for AI agent observability and shared project state. The Service ingests agent and human activity as events, derives observations and claims, maintains temporal workspace state, and exposes APIs and a web console for inspection, search, and explanation.
We may add, change, or discontinue features. We will use reasonable efforts to avoid breaking changes within a published API version without notice, but beta or preview features may change at any time.
- Event ingestion and append-only activity logs
- Derived observations, claims, and current-state views
- Hybrid retrieval (structured and vector search)
- Run traces, issue detection, and explanations
- API keys, SDKs, CLI, and MCP integrations
3. Accounts and access
Console access requires an account authenticated through our identity provider (Supabase Auth), which may include Google, GitHub, or email magic link sign-in.
You are responsible for maintaining the confidentiality of your credentials and API keys. Notify us promptly via our contact form (https://www.graphe.cloud/contact) if you suspect unauthorized access.
You must provide accurate registration information and keep it current. One person may not maintain more than one free-tier workspace for the purpose of evading usage limits.
4. Acceptable use
You agree not to misuse the Service. Prohibited conduct includes:
- Violating applicable law or third-party rights
- Sending malware, unlawful content, or data you lack rights to process
- Attempting to probe, scan, or compromise our systems or other customers' workspaces
- Circumventing rate limits, authentication, or billing controls
- Reselling the Service without a written agreement
- Using the Service to build a competing general-purpose graph database marketed as a substitute for Graphe's core product
5. Your data
You retain ownership of data you submit to the Service ("Customer Data"), including events, metadata, API payloads, and configuration. You grant Graphe a limited license to host, process, transmit, and display Customer Data solely to provide and improve the Service, comply with law, and prevent abuse.
You are responsible for ensuring you have appropriate rights and notices for any personal data or third-party content included in Customer Data.
Our Privacy Policy explains how we handle personal information. It is incorporated into these Terms by reference.
6. API keys and security
API keys authenticate programmatic access to your workspace. Keys are shown in full only at creation; store them securely.
You are liable for activity under your keys until revoked. Rotate keys if they may have been exposed.
Do not embed production keys in public repositories, client-side applications, or untrusted environments.
7. Plans, billing, and usage
We offer free and paid plans with usage limits (such as events per month) described on our pricing page. Exceeding limits may result in throttling, suspension, or required upgrade.
Paid subscriptions, when available, are billed through our payment processor (Stripe). Fees are non-refundable except where required by law or stated in a separate order form.
We may change prices with reasonable notice. Continued use after a price change constitutes acceptance for renewal periods.
8. Intellectual property
Graphe owns the Service, software, documentation, branding, and all related intellectual property, except for Customer Data and open-source components subject to their own licenses.
We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription or free access period, in accordance with these Terms.
Feedback you provide may be used to improve the Service without obligation to you.
9. Third-party services
The Service relies on third-party infrastructure and integrations (for example cloud hosting, databases, authentication, and payment processing). Your use may also be subject to those providers' terms.
Links to third-party sites are provided for convenience; we are not responsible for their content or practices.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, error-free, or that agent outputs, issue detection, or explanations will be accurate or complete. You are responsible for decisions made based on information from the Service.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAPHE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You will defend and indemnify Graphe against claims arising from your Customer Data, your use of the Service in violation of these Terms, or your violation of law or third-party rights, except to the extent caused by our gross negligence or willful misconduct.
13. Termination
You may stop using the Service at any time. You may request account deletion via our contact form (https://www.graphe.cloud/contact), topic "Privacy / data request".
We may suspend or terminate access for violation of these Terms, non-payment, risk to the Service or other users, or as required by law. We will use reasonable efforts to provide notice when practical.
Upon termination, your right to access the Service ends. Provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.
14. Changes to these Terms
We may update these Terms from time to time. We will post the revised version on this page and update the effective date. Material changes may be communicated via email or in-console notice.
Continued use after changes become effective constitutes acceptance. If you disagree, discontinue use before the effective date.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory local law applies.
Disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Either party may seek injunctive relief for misuse of intellectual property or confidential information.
